The Permanent seasonal (fijo discontinuo) contract type is sometimes referred to as fijo discontinuo or fixed-discontinuous contract. In this article, we use Permanent seasonal contract consistently.
Overview
The Permanent seasonal contract is designed for employees who work intermittently throughout the year, returning for recurring periods instead of working continuously. This contract type helps HR teams accurately track periods of activity and inactivity, manage payroll efficiently, and ensure compliance with local labor regulations.
When and Why It Should Be Used
Use Permanent seasonal contract when employees do not work continuously throughout the year but return periodically. This ensures accurate contract tracking, payroll management, and compliance with labor regulations.
How to Use
View Permanent seasonal contract information
Go to the employee’s Contract tab
Check the Permanent seasonal contract section to see:
Current contract status
Start date of the current activity period
Total active days since the contract started
Active days during the current year
Activate a Permanent seasonal contract
Go to the employee’s Contract tab
Click Start activity period
In the pop-up, set a start date for the next active period
If needed, select an onboarding flow for the employee
Click Save

In your sidebar, go to Organization tab
Select the employee or the employees you want to do this action
A pop-up will appear to select the option: Switch to a permanent seasonal contract Once the contract has been marked as Permanent seasonal contract, you will be able to pause and reactivate it as many times as needed, following the same process, depending on the company’s needs.
Deactivate a new ‘fijo-discontinuo’ contract
Go to the employee’s Contract tab
Click End activity period
In the pop-up, set an end date for the current active period (can be in the future)
Set a termination date to revoke the employee’s access to Factorial
Choose a termination reason (Inactivity period)
Optionally, select a user to reassign tasks/responsibilities
Click Save
Bulk Actions
Bulk Activation
Go to Organization → People
Select the employees you want to activate
Use the floating menu at the bottom and expand Edit employees
Click Start activity period
On the next page, set start dates for each employee
Click Save changes
Bulk Deactivation
Go to Organization → People
Select the employees you want to deactivate
Expand Edit employees from the floating menu
Click End activity period
Set end dates for active periods and the Factorial access termination date for each employee
Optionally assign a user to reassign tasks
Click Save changes
Filtering Employees by Permanent seasonal contract
Go to Organization → People
Open the table filters
Choose Contract status and select:
Activity Period (Permanent seasonal)
Inactivity Period (Permanent seasonal)
Click Apply filters
Report of all Permanent seasonal employees
Go to Analytics
Click + Create Dashboard
Add a title and description
Select Factorial Templates
Find the Permanent seasonal contract information widget
Click Add widget to dashboard
Choose the dashboard layout you want to use
Click Save
Troubleshooting / Common Questions
Why can’t I see the Permanent seasonal contract option? This feature is only available in the Spanish market with an Enterprise subscription.
I don’t have the option to activate/deactivate, what do I do? Check your role permissions in Settings → Permissions. You need Admin or HR Manager access to perform these actions.
Employees still appear active after deactivation. Deactivating a contract does not delete the employee. They remain in the system but are marked as inactive and lose platform access until reactivated.
What happens when a contract is deactivated? The employee is excluded from active employee lists and payroll processes. Historical data remains available for reporting and compliance.
Can a Permanent seasonal contract be changed to a permanent contract? Yes, it is possible to change a Permanent seasonal contract to a permanent one, as long as new conditions are created. When creating New Conditions, users can decide whether those conditions will follow the Permanent seasonal logic or not. Just below the Contract Type section, there is a toggle that allows users to indicate if the new conditions should be Permanent seasonal.
Please note that if the user uses the Fix conditions functionality (which overwrites the current conditions), it will not be possible to modify whether the contract is fijo-discontinuo or not.
